Any copying, reproduction, modification, reissuing, uploading, distortion, transmission, or distribution, in whole or in part, of these elements on any medium without the prior written authorization of EXPERIENCIAH is prohibited, except for strictly personal, private, and non-commercial use without modification of the elements on the site. RIGHTS OF EXPERIENCIAH GROUP AS DATABASE PRODUCER

Clients, prospects, and partners have the right to consult the information on www.kaanhotels.com for their own hotel booking needs. They may extract or reuse part of the content for personal purposes, provided that it does not concern a substantial part of the content, either qualitatively or quantitatively. However, repeated extraction and/or reuse of the content, even if not substantial, is prohibited. Total or partial reproduction of the site for other purposes is strictly forbidden. Public communication of all or part of the site's content is also prohibited, regardless of form or destination. Commercial use of the site's content is expressly prohibited.

LIABILITY

The information accessible on www.kaanhotels.com is provided "as is," without explicit or implicit warranty from EXPERIENCIAH, which cannot be held responsible for its use by the user. These terms of use may be modified at any time by EXPERIENCIAH, which reserves the right to do so. The user agrees not to disclose illegal, defamatory, or public order-contrary information via this site, under penalty of civil or criminal liability. Although EXPERIENCIAH strives to provide reliable information and tools, it cannot guarantee the absence of errors, constant availability of information, or the absence of viruses on its site. External sites linked to this site are not under EXPERIENCIAH's control, which cannot be held responsible for their content or use by the user.

PREAMBLE TO THE GENERAL TERMS

These general terms (hereinafter the "General Terms") aim to define the terms and conditions under which EXPERIENCIAH allows its clients (hereinafter the "Client(s)") to benefit from all services, notably booking, available on this site and described below (collectively the "Services").

Before any booking of a Service on the Site, the Client declares (i) that they act for personal purposes not related to commercial, industrial, artisanal, liberal, or agricultural activity and (ii) have full legal capacity to commit under these General Terms.

Clients are strongly advised to carefully read and save a copy of these General Terms as well as the Specific Terms applicable to each establishment.

EXPERIENCIAH reserves the right to modify or supplement the General Terms at any time. The new version will be available on the Site with its effective date. Clients are advised to regularly consult the General Terms for any changes. However, the Client will only be bound by the version in force at the time of the Service booking.

DESCRIPTION OF SERVICES

SERVICES

The EXPERIENCIAH services offered on www.kaanhotels.com include two types: Accommodation Services for booking hotel rooms or other accommodations, and Additional Services. Accommodation Services and Additional Services are jointly referred to as "Kaan Hotels Services."

ACCOMMODATION SERVICES

The Site allows clients to book rooms in Kaan Hotels. The essential characteristics of the establishments, their availability, price, options offered, payment conditions, and special sales conditions applicable to the selected rate (such as guarantee policies, cancellation conditions, check-in times, member rates, etc.) are presented during the booking process described in the BOOKING PROCESS section below.

Each establishment has its own Specific Terms applicable to the selected rate, also available on the Site. These Specific Terms are presented to the Client before any booking and may include details such as check-in and check-out times, guarantee policies, cancellation deadlines, Wi-Fi access, specific conditions for children.

ADDITIONAL SERVICES

The Site also allows booking Additional Services, such as breakfast upon arrival or upgrades to Accommodation Services, spa treatments (subject to the Specific Terms defined by the Establishment).

Additional Services also include travel services that may form with Accommodation Services either a "travel package" or a "tourist package." This information is communicated to the Client prior to booking these services in the Specific Terms for each offer.

Booking a combination of travel services such as accommodation, transportation, car rental, and other tourist services (tours, excursions, experiences, etc.) may constitute a linked travel package or tourist package.

For example:

  • Booking a car rental offered within 24 hours after booking an Accommodation Service.

  • A massage or facial treatment.

PARTNER SERVICES

EXPERIENCIAH enters partnerships and distribution agreements with third-party websites ("Partners") to allow the Client to search, select, and book rooms in EXPERIENCIAH establishments on the partner's website (the "Partner Services").

The sales conditions applicable to these Partner Services are available on the Partner’s website.

BOOKING PROCESS

The process on the Site allows the client to choose any presented service.

BOOKING SERVICES

Clients of EXPERIENCIAH can book Kaan Hotels Services via the website. The booking process may vary depending on client navigation and request and consists of the following steps:

  • Entering search criteria for destination, establishment, and additional services if needed.

  • Viewing results and selecting the establishment and additional services if applicable.

  • Viewing details and characteristics of selected services, especially for accommodation, including room size, offered amenities, length of stay, breakfast and Wi-Fi options, total booking price, applicable taxes, and any special conditions such as cancellation policies and check-in times.

  • Summary of booking with main characteristics and entering client details to create a member account or loyalty program with EXPERIENCIAH.

  • Finalizing the booking by entering payment information and accepting general and specific terms of the booking.

  • Sending a booking confirmation email summarizing booking details and accepted conditions.

PRICES

Prices for Services booking are displayed during the booking process. For Accommodation Services, prices are shown per room for the chosen date and number of people. Once confirmed, the total all taxes included price is indicated to the Client in the establishment’s commercial currency, which may differ from the local currency. This price is valid only for the duration specified on the Site. If payment is made in a different currency than that confirmed at booking, exchange fees are borne by the Client. Any currency conversion displayed on the Site is indicative only.

Tourist tax is payable directly at the Establishment unless prepaid online where it may be included in the total amount.

Prices include VAT in force at the time of booking, but any VAT rate change will be automatically reflected in the billed price. Any new tax imposed by authorities will also be automatically added.

Certain promotional offers are only available on the Site and cannot be purchased at the Establishment reception.

PAYMENT

GENERAL PROVISIONS

The client must provide payment information when booking on the site, either to prepay before the stay or to guarantee the reservation. The client must enter their credit card information directly in the secure SSL-encrypted zone, without spaces between digits. Cardholder name, card number, and expiration date must be provided for prepayment via EXPERIENCIAH's chosen payment platforms. Payment partners will verify the card validity, which may be refused for various reasons like stolen or blocked card, reached limit, or input error. In case of issues, the client must contact their bank and the establishment or other entity to confirm the booking and payment method.

If payment is made at the establishment or another entity, accepted payment methods may differ. The establishment may also request ID to prevent credit card fraud.

PREPAYMENT

Prepayment refers to any amount paid by the client at the time of booking.

At prepayment, the charged amount corresponds to the total amount indicated during booking (including all applicable taxes except tourist taxes) and, if applicable, the cost of options selected by the client as described in ADDITIONAL SERVICES above.

CREDIT CARD GUARANTEE

Reservation guarantee by credit card means that payment data is collected during booking. The client's card is not charged, and stay payment is made directly at the establishment on arrival or departure day according to establishment conditions, unless the client does not show up and did not cancel according to cancellation conditions of the booked rate.

NO-SHOW

If the Client does not show up on the first day of their Accommodation Service booking, the Establishment will fully cancel the Client's reservation and release the reserved rooms for sale. If the reservation was non-cancellable, non-exchangeable, and/or non-refundable, the Establishment will retain all sums paid by the Client. If cancellable, exchangeable, and/or refundable and guaranteed by credit card, the Establishment will charge the card provided during booking for the total price of the first reserved night and cancel subsequent nights free of charge. In this case, the Client has no right to refund or compensation, and the Establishment will resell the rooms. For prepayment of a non-cancellable, non-exchangeable, and/or non-refundable booking, the charged amount includes the total booking amount and price of options selected by the Client as per BOOKING PROCESS.

CANCELLATION OR MODIFICATION OF A SERVICE BOOKING

Cancellation/modification terms are specified in the Specific Terms for each service booking. Prepaid bookings are non-modifiable and/or non-cancellable, and deposits are non-refundable. Cancellation or modification can be made via the customer relations center or directly with the establishment. If the client interrupts the service, the agreed price will be fully charged without refund in case of prepaid booking. Unless otherwise specified, the client must leave the room before the departure time indicated by the establishment; otherwise, an additional night will be charged.

CLIENT'S COMMITMENTS AND LIABILITY

The Client is responsible for choosing the Services based on their needs. Consequently, EXPERIENCIAH cannot be held responsible for this selection. The Client is also responsible for providing accurate information and must not communicate misleading or fraudulent information when creating an account or booking a Service.

Moreover, the Client is responsible for their account use, even if used by a third party, and must immediately report any fraudulent use of their email address to EXPERIENCIAH. Failure to comply with these Terms makes the Client liable for damages caused to EXPERIENCIAH or third parties and must indemnify EXPERIENCIAH for all related costs. Booking or payment irregularities, invalid, incomplete, or fraudulent, will lead to cancellation of the booking at the Client’s expense, and EXPERIENCIAH may take action against them. The Client must respect Establishment rules and must not disrupt or compromise the Establishment's safety. Minors may only stay accompanied by an adult and with personal ID. Also, the Client must not use Establishment IT resources for illegal or unauthorized purposes and must comply with the Establishment's internet provider security rules.

EXPERIENCIAH'S COMMITMENTS AND LIABILITY

EXPERIENCIAH commits to providing access to the site and services according to the general terms and to promptly fix any reported malfunction within reasonable limits.

However, EXPERIENCIAH may temporarily suspend the site for technical maintenance without notice.

The client acknowledges that EXPERIENCIAH cannot be held responsible for inconveniences or damages related to internet network use, especially data transmission or network failures.

EXPERIENCIAH is not responsible for the content of third-party websites accessible via hyperlinks on the site.

FORCE MAJEURE AND RELOCATION

Neither party can be held liable for failure to perform obligations due to force majeure. Both parties agree that force majeure suspends reciprocal obligations, each bearing related costs. If force majeure lasts more than thirty (30) days from its occurrence, these General Terms may be terminated by either party without damages.

In case of force majeure, exceptional event, or impossibility to provide the Service, including making the reserved room available, the Establishment may relocate the Client wholly or partly to an equivalent establishment or provide a similar Service, subject to Client's prior agreement.

Clients agree to remain courteous in exchanges with customer service and avoid derogatory remarks towards EXPERIENCIAH, Establishments, group entities, or employees. EXPERIENCIAH reserves the right to take appropriate measures in case of harmful or reprehensible behavior (such as rude, malicious, or insulting) towards EXPERIENCIAH, Establishments, group entities, or employees.

MISCELLANEOUS

By accepting the General and Specific Terms electronically and providing payment information, parties conclude an electronic contract that proves the Service booking and payment obligations. The General and Specific Terms express all parties’ obligations, and no other Client condition will be integrated. In case of contradiction between Specific and General Terms, Specific Terms prevail for the issue in question. If a partner’s general terms contradict these, these Terms prevail.

By accepting these General Terms and using our online services, you consent to the processing of your personal data and, if applicable, its transfer abroad for service execution.
